1. INTRODUCTION

The purpose of this privacy notice ("Notice") is to inform you of how Kawasaki Heavy Industries, Ltd. ("we", "us" and "our"), the operator of “Rideology the APP” (our “Application”), will process your personal data as a data controller when you send us a message regarding the Application, and to inform you about the measures and processes we have put in place to ensure the adequate protection of your personal data. Providing such information is one of the requirements of the General Data Protection Regulation 2016/679 ("GDPR").

This Notice does not form any contractual relationship between you and us, and we may amend it from time to time.

2. REGARDING PERSONAL DATA WE COLLECT ABOUT YOU

2.1 To send us a message regarding our Application, you will need to provide the following data:

  • e-mail address.
  • In addition, if you send a message through the contact form in our application, you will need to provide the following data:
  • your country, region, language
  • model name of your device
  • version information of your phone’s operation system and our Application
  • name of our Application
  • model name of your motorcycle
  • model year of your motorcycle

2.2 We make every effort to maintain the accuracy and completeness of your personal data and to ensure all of your personal data is up to date. However, you can assist us with this considerably by promptly contacting us if there are any changes to your personal data or if you become aware that we have inaccurate personal data relating to you (see Section 7 below). We will not be responsible for any losses arising from any inaccurate, inauthentic, deficient or incomplete personal data that you provide to us.

3. HOW WE USE PERSONAL DATA – PURPOSES OF PROCESSING

3.1 We will process your personal data we collected in connection with our Application (see Section 2.1) to be able to provide our services in connection with our Application to you. The legal basis for this processing is the performance of the services you have requested (Art. 6 para. 1 lit. b) GDPR).

3.2 We may also process your personal data to understand our customers better so that we can further improve and develop our products, services and stores.

  • The legal basis for this processing is our legitimate interest (Art. 6 para. 1 lit. f) GDPR). The legitimate interest we pursue in this case is the improvement of our Application and the related services.
  • You have the right to object, on grounds relating to your particular situation, at any time to such processing. To exercise this right, you may at any time contact us as provided in Section 10 of this Notice.

4. INTERNATIONAL TRANSFERS OF PERSONAL DATA

Your personal data will be collected and stored in our Japan office.

The data may be transferred in an aggregate, anonymized format within our group of companies in Europe, in particular to Kawasaki Motors Europe N.V. (the Netherlands).

5. WHEN WE MAY DISCLOSE YOUR PERSONAL DATA

We do not and will not sell, rent out or trade your personal data. We will only disclose your personal data to the following recipients:

  • (a) to third parties who process your personal data on our behalf (such as our system providers including cloud providers); where such third party data processors are located outside the European Union respectively the European Economic Area, such third party processors are either located in a third country where the European Commission has decided that this country ensures an adequate level of data protection or appropriate safeguards for an adequate level of data protection are provided for by standard data protection clauses that have been adopted by the European Commission and that have been entered into between us and the third party data processor;
  • (b) to any third party to whom we assign or novate any of our rights or obligations;
  • (c) to any prospective buyer in the event we sell any part of our business or assets; or
  • (d) to any government, regulatory agency, enforcement or exchange body or court where we are required to do so by applicable law or regulation or at their request.

We are committed to safeguarding and protecting your personal data and will implement and maintain appropriate technical and organizational measures to ensure a level of security appropriate to protect your personal data from accidental or unauthorized destruction, loss, alteration, disclosure or access.

7. YOUR RIGHTS IN RELATION TO THE PERSONAL DATA WE COLLECT

7.1 If you wish to:

  • (a) rectify or delete your personal data, or obtain access to your personal data and a copy of your personal data that we hold; or
  • (b) restrict our processing of your personal data or stop us from using any of your personal data which we hold; or
  • (c) receive the personal data concerning you and which you have provided to us in a structured, commonly used and machine-readable format or to transmit those data to another controller (right to data portability),

  • you can request this by contacting us as set out in Section 10 below.

7.2 In any of the situations listed above, we may request that you prove your identity by providing us with a copy of a valid means of identification in order for us to comply with our security obligations and to prevent unauthorized disclosure of data.

8. HOW LONG WE WILL HOLD YOUR PERSONAL DATA FOR

We will only retain your personal data you provided to us in connection with our Application for one year to fulfill the purpose for which it was collected.

9. HOW WE UPDATE OR CHANGE THIS NOTICE

We may change or update parts of this Notice in order to maintain our compliance with applicable law and regulation or following an update to our internal practices. We will do this by updating this Notice in our Application. You will not necessarily be directly notified of such a change. Therefore, please make a request as set out in Section 10 below if you want to be fully aware of any changes or updates.
